  Anthropology of Islam, especially sharia, and themes of ethics, law, rules and authority. 

• Presentation :
  Baudouin Dupret and others have advanced the thesis of a global shift in legal paradigms since the late eighteenth century, a process of ‘positivization’ such that we can now think in terms of ‘a Great Divide’ between the pre- and post-positivization eras. Speaking of contemporary forms of ‘Islamic law’ as though they were continuous with pre-modern sharia would thus be anachronistic. In previous research (in 2007-8), I documented judicial practice in Lebanon’s ‘sharia courts’ (mahakim shar‘iyya), i.e. family law courts for Lebanon’s Muslims. On the one hand, it seems true that Lebanon’s contemporary sharia courts are a quintessentially modern phenomenon, embedded within the legal system of the Lebanese state. On the other hand, it is not so easy to deny altogether the relevance to sharia court practice of religious ethics, assumptions and networks. In this presentation, I will argue that while examining judicial practice in Lebanon’s sharia courts certainly confirms some aspects of the positivization thesis, it also throws into relief some of its potential shortcomings.
